Parliament starts consideration of President's veto on changes made to election legislation and rules of procedure

The Parliament is starting the consideration of the President's veto – the so-called motivated remarks in connection with the changes made tothe election legislation and rules of procedure.

The motivated remarks will be discussed tomorrow by the legal issues committee of the Parliament and according to preliminary information, it will be presented at the plenary session next week.

The President vetoed the amendments made by the Parliament to the Election Code, which cancels the position of the deputy chairman of the Central Election Commission, who is appointed from the opposition. In addition, the amendments provide for a change in the procedure for electing CEC professional members and chairman. The procedure for their election is 3-stage - namely, in the first stage, the election of the CEC member and chairman will be possible with the support of three fifths (90 votes) of the Parliament. If the candidates do not get a sufficient number of votes, the Parliament will take a decision with a simple majority (76 votes) in the second ballot. In case of another failure, voting will be held according to the same principle. If the Parliament is not able to elect professional members and the chairman of the CEC even in this case, the authority to appoint candidates will be transferred to the President.

With the draft law adopted by the Parliament, the following changes implemented in the election legislation and the Parliament's rules of procedure remain in force: instead of the President, the Chairman of the Parliament will announce the candidate selection contest and the Chairman of the Parliament will present the nominations of the CEC chairman and members to the Parliament.

As for the veto, the President proposes that the commission for selection of the chairman of the CEC and professional members should be created and candidates should be presented to the Parliament for election by the President. In addition, according to the President, in order to ensure high confidence in the CEC, it is important to maintain the post of the deputy chairman of the CEC appointed by the opposition parties.

In the document submitted to the Parliament, it is emphasized that as a result of the legislative changes, the role of the President in the process of appointment of the CEC chairman and members is limited.

According to the reports, the majority will override the veto, for which it needs as many votes as it needs to pass the draft law (76 votes).
